Another New Drug Law in Thailand – More Good News for Drug Case Defendants

This latest post from the lawyers at Thailand Bail focuses on yet another new drug law in Thailand. However, this post today is about the brand new law that was enacted just yesterday on 09 June 2022 in regards to marijuana, also known as ganja. Thousands of drug suspects have been released from Thailand’s prisons because of this new law, and your friend or family member’s case may also benefit.

According to media reports, such as in the Bangkok Post, over 4,000 prisoners in the prisons across the Kingdom of Thailand were deemed eligible for early release. However, the actual number of prisoners in Thai prisons that will be released remains to be seen. For example, the processing of these inmates will likely take time, and many will need the assistance of law firms to lodge petitions for consideration under the new law.


Who Will Benefit from the New Marijuana Law in Thailand?

Since the new marijuana law in Thailand just took effect yesterday on 09 June 2022, it is yet to be seen exactly who will benefit. I Was Blacklisted for a Ganja Case in Thailand – Will the New Ganja Law Help Me?

This is a good question, as many foreigners have been blacklisted from Thailand for small ganja cases. Many received poor legal advice stating that they would have no problem because “ganja is not serious” in Thailand. However, prior to this new law, ganja cases resulted in a very serious immigration blacklisting – up to 100 years.

If you were blacklisted from Thailand for a ganja case, the solution involves an extra step. Firstly, we will need to have your case considered under the new law. Secondly, we will need to make sure the system / database used by the relevant Thai authorities is updated with the new information.

Is Marijuana Now Free to Use in Thailand?

We do not recommend using, possessing, or being involved with marijuana in Thailand at this point. The new law is very new, and some police officers may not yet have a clear understanding of the new law. In addition, extract of marijuana with a THC level above 0.2% is still illegal. Accordingly, we advise not to be involved with marijuana (ganja) or any other drug in Thailand.
