THAILAND BAIL GETS REPEAT OFFENDER OUT ON BAIL

SUMMARY

Thailand Bail was asked to work on a special case involving a woman (“Jennifer”) in Pattaya who was arrested, but was out on bail awaiting her trial. Unfortunately, Jennifer was arrested again for the same crime, operating an illegal business. Repeat offenders are almost never given bail, since judges do not see any reason to release someone who will just go and commit the same crime again. The chance that someone will repeat the same crime again is one of the most commonly reported reasons for bail being rejected. Despite the challenges, Thailand Bail’s legal team managed to successfully post bail for Jennifer, at the same amount of money for the first bail. This was important for Jennifer, because the slow Thai court system had taken 12 months to schedule her first trial, and being out on bail allowed her the freedom to enjoy a normal life before her trial in Pattaya Court.


BACKGROUND

Some of our clients get arrested for operating illegal businesses. Some of the laws in Thailand are applied differently in different districts, so it is easy for someone like Jennifer to be on the wrong side of the law. Jennifer was arrested in Pattaya the first time, and paid a lot of money to another law firm to post bail for her in Pattaya. After Jennifer was waiting for her first trial, which took 1 year to come about, she was arrested in the same district in Pattaya, for the same crime, under the jurisdiction of the same court! While Thailand Bail does not condone violation of bail by being involved in criminal activity, our duty is to help our clients in the best way we can. The previous law firm that Jennifer hired wanted an extraordinarily high fee (175,000 Thai baht) to process bail for the second time. One of Jennifer’s friends found the Thailand Bail website online and contacted one of our international case specialists. After discussing the situation with us, Jennifer decided to hire us to handle her bail for the second time.


BAIL SUCCESS

Thailand Bail often takes cases that other law firms will not. This is typical of Thai law firms; they want easy cases that they can make high fees off of. At Thailand Bail, we investigate carefully every case that comes across our desk, to see how we can help our clients. If there is nothing we can do, we tell people this. However, in Jennifer’s case, we knew that we could probably get bail for her, without the high fees charged by the other Thai law firm. Sure enough, our bail lawyers were able to post bail for this repeat offender, and we were even able to keep the bail amount the same as the first bail (200,000 THB). Our fee was much, much less than the other law firm’s fee, and we were able to do what most cannot – get bail for a repeat offender.
