Blacklisted in Thailand: What to do if Thai Immigration Blacklisted You

“I tried to fly into Bangkok but immigration refused to let me enter the country because they said I was blacklisted.” We have heard this story told by many people who have had the unpleasant experience of being blacklisted by Thai immigration and refused entry into the country. Getting blacklisted is a waste of time and money. Our lawyers and staff have received many requests for help from people who get stopped at Don Meuang International Airport (DMK) or Suvarnabhumi International Airport (BKK). However, it is much easier for our lawyers to assist with your potential blacklist before you get stopped – and potentially arrested – for trying to enter the country.

Avoiding the Blacklist

Thailand Bail specializes in criminal cases, so our lawyers in Bangkok are familiar with every element of a criminal case. These elements include bail, bail appeals, criminal defense, fighting cases, accepting charges, doing 100/2 procedures, and making sure our clients do not get blacklisted. Most Thai lawyers will not think ahead, and this means that many defendants get blacklisted for a long time when they could have avoided the Thai immigration blacklist with the help of a reliable Thai law firm like Thailand Bail. One of the most common issues with the Thai blacklist that we have seen in Bangkok, Phuket, Chiang Mai, and elsewhere is the problem with defendants in minor criminal cases. Almost all other Thai lawyers that we have encountered do not give proper advice for dealing with blacklists, and their clients get blacklisted for many years.

How to Get Blacklisted in Thailand

We have seen many examples of the blacklist in Thailand. One story is that a defendant with a drug case – specifically marijuana – was convinced to plead guilty to the charges. Instead of just paying a fine, as is the case sometimes with small ganja cases, this defendant spent 2 weeks in a Thai prison. After he was released, he was immediately taken to the Immigration Detention Centre (IDC) in central Bangkok.

Finally, he was able to get a flight back to the UK, but before getting deported, he was also blacklisted for 10 years. Another story follows the previous one (small marijuana possession case), but this defendant did not go to prison, and he just plead guilty to the charges and paid a fine. However, he was re-arrested by the police after court, forced to pay certain fines to the police, and then transferred to the immigration department. He was stuck in a different Immigration Detention Centre (IDC) in a province outside Bangkok. He had to pay special fees in order to get a flight to the main IDC in Bangkok, and was further detained until he was deported, but not before being blacklisted for 15 years. One final story involves a defendant who had a small criminal matter in his home country. For some reason, the police in his home country notified the police in Thailand, and this defendant was made persona non grata in Thailand. We were able to find out that Thailand had issued a notice for this defendant, and if he had flown to Thailand, he would have been denied entry. Furthermore, he was also blacklisted from entering the country for 25 years because of this.
